RI Attorney: Here’s What Raised Flags With Immigration Documents

Joseph Molina Flynn, who practices immigration law in Rhode Island and Massachusetts — and was recently elected the head of the Rhode Island Latino Political Action Committee, spoke to the documents presented to him by a Venezuelan national who reached out after applying for a work permit through “A New Beginning for Immigrants’ Rights.”
“What notarios pitch for work permits vary widely — I’ve heard from $1000 to $8000,” said Flynn, who spoke to the inconsistencies — and inaccuracies — in the forms that led him to believe fraud was committed.

GET THE LATEST BREAKING NEWS HERE -- SIGN UP FOR GOLOCAL FREE DAILY EBLAST“This is something you file with immigration to say you're the attorney and that you're representing someone else -- in what we call affirmative processes when you're not in deportation,” said Flynn of the filled-out form, when presented. “According to this, it was filled out by the Carlos Davila, and this one lists the Olneyville address.”
“He had my client sign it -- but there is not a signature for whoever the representative was, who should have signed,” said Flynn. “He gave [the victim] a copy when he asked from proof -- these didn't go anywhere.”

“This is also an entry of appearance, but this used in immigration court -- which means this is in deportation,” said Flynn of the documents provided by the victim. “You can get these blank forms off Internet. So on this one, the weird thing is an A number -- there's a spot for an alien number, which he wrote in, but the only way you get an A number is once you've had some encounter of immigration. You've either applied for something, or are in deportation. The number he had was 6 digits...but a real A number is 9 digits.”
“Then there’s the attorney checklist -- you're an attorney, or an accepted representative or other things,” said Flynn” He checked off accepted representative, and reputable individual -- if was an acceptable representative you would not have had to check off another box.”
“Then down where it asks for EOIR, where it says you have the authorization to represent people in court -- he had [the victim] t sign it,” said Flynn. “They didn't complete any of the information.”
NOTICE OF HEARING
“Finally, there’s the issue of the notice of hearing,” said Flynn. “The victim’s name is written in. Immigration would never do that, would be typed.”
“This A number is typed -- which leads me to believe there was a space for the first three digits, he just used the last six digits,” said Flynn. “Again, it’s supposed to be 9 digits.”
“And where it says attorney or representative, it has [and] acronym written,” said Flynn “That would be typed. And the date for 2018, you can see it was 2016. The only way he could have gotten this was to doctored original. And it has a judge signature -- he's misappropriating the judicial system.”
